Speaker Spotlight

This month’s guest speaker at the Graphic Artist Guild luncheon will be Sam Day. We had a moment to sit down with Sam and ask him a few questions for this month’s Spotlight.


GUILD: Every business has a special ‘niche’ it either targets or is known for, what is yours?
DAY: My career has had multiple personalities for so long, I don't feel I fit in a niche very well.

GUILD: When did you first decide to enter this industry?
DAY: I was first published as an illustrator at age eleven, and did political cartoons for small town newspapers throughout high school. I became a full time freelancer in 1992.

GUILD: How did you come up with your company name?
DAY: The name on my business license is Sam Day-Illustrator, which took no thought whatsoever. The tag line I've used since the early nineties, "I Draw Pictures," is simply what I do.

GUILD: What type of education did you have and has it served you well?
DAY: I have an associate degree from the Art Institute of Seattle. It was a good foundation, but continual learning has been just as important.

GUILD: Who was your greatest influence?
DAY: My parents.

GUILD: Careers often change direction, has yours?
DAY: My career runs aimlessly around the playground.

GUILD: How does the post-computer marketplace compare with the pre-computer marketplace?
DAY: I'm afraid we're stuck with computers until something better comes along. Surely the most significant impact that computers have had on our profession is neither the creation of new tools nor the efficiency of communication and delivery, but rather the invention of the searchable database—which made stock illustration possible, for good or ill.

GUILD: What is the most significant trend you are currently experiencing?
I'm not yet old enough to be aloof from trends. But I still have yet to get a tattoo.

GUILD: When did you first join the Graphic Artists Guild?
DAY: When the SPGA affiliated therewith.



GUILD: What influence you to join?
DAY: I joined the original SPGA to network with other graphic artists, and to learn the business from more experienced professionals.

GUILD: What are your plans for the future?
DAY: Television.

Guild Announces New National Teleclass Series

The Graphic Artists Guild is pleased to announce the launch of it’s National Teleclass Series. Now you can attend lectures of interest regardless of your location or schedule by phone. The telecasts are done live with recordings sent to those attending who request. And the first telecast will be…

COPYRIGHT ISSUES FOR WORKING ARTISTS

Copyright law can provide far more protection than many artists realize, and simple steps — such as registering your work and sending DMCA (and if you don’t know what DMCA means, you need to attend this teleclass) notices to on-line infringers — can be taken easily and effectively without hiring a lawyer. You can negotiate common contract terms without outside legal help. This program will tell you what to look out for, what to insist on, and how to approach the negotiation process; it’s never just a matter of “take it or leave it.”

For contracts you’ve already signed, the session will help you determine what rights you have

— particularly rights in new media. For those who incorporate pre-existing images or materials into their work, the session will discuss fair use and public domain principles to help ensure that you don't inadvertently violate someone else’s copyright.

This teleclass will focus on copyright issues most relevant to working artists, including work-for-hire, joint authorship, copyright notice and registration, electronic rights, fair use, and stopping infringements. Fifteen minutes of the program will be devoted to answering your specific questions. By attending this teleclass, you will gain the most useful information about copyright that you’ve ever heard in 90 minutes.

Bob is a partner at the New York firm of Cowan, Liebowitz & Latman in New York, who litigates and advises clients on copyright issues in a wide variety of industries. His clients in the art world include Barbara Kruger, The Art Institute of Chicago, Blue Man Group, ARTstor, and Sotheby’s. Bob has spoken and written extensively on copyright issues, and is co-author, with Tom Kjellberg, of the annual review of copyright decisions published each year by the Journal of the Copyright Society of the USA. Bob teaches a seminar on emerging intellectual property issues at Columbia Law School and is chair of the Copyright and Literary Property Law Committee of the New York City Bar. Bob is a 1993graduate of Columbia Law School.
